General Terms of Sale

ARTICLE 1 – SUBJECT MATTER

These general terms and conditions of sale (hereinafter "General Terms") govern the purchase of products made remotely via the internet, through the website identified at the URL www.fabiox.it. The website is owned by Fabiox di Fabio Bertini, with registered office at Via Marconi no. 21, Forlimpopoli (FC), Italy – VAT no. 04124500408 (hereinafter "Seller"), which directly manages its content and handles the commercial, organisational, logistical, and administrative-accounting aspects of sales.

ARTICLE 2 – ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE

All purchases made through the website www.fabiox.it by users accessing it (hereinafter "Customers") are governed by these General Terms, as well as by the Consumer Code (Legislative Decree no. 206/2005), Section II – Distance Contracts (Arts. 50–67), and the regulations on e-commerce (Legislative Decree no. 70/2003). Submission of the completed online order form by the Customer, following the instructions and procedures described below, constitutes not only a commitment to purchase, but also acknowledgement and full acceptance of these General Terms. The Customer is therefore invited to read these General Terms carefully before making any purchase and, once the order has been placed, to print or otherwise retain them in their preferred format. The purchase contract for the products shall be deemed concluded at the moment the Customer receives an email from the Seller confirming acceptance of the order. The Seller may modify the content of the General Terms at any time and without prior notice; however, the version published on the website at the time the Customer submits the order form shall apply to that transaction.

ARTICLE 3 – ACCOUNT

To make purchases on www.fabiox.it, Customers must create a password-protected account by completing the registration form. Registration is entirely free of charge. Customers will be granted access to their account and private area at all times, where they can view and update their personal details, monitor current orders, and review their purchase history.

ARTICLE 4 – PRICES

Product prices are listed on the website and are expressed in Euros, inclusive of VAT. Shipping costs are not included in the sale price; they are shown separately and added to the total amount before the order is completed. Any promotional discounts are clearly indicated.

ARTICLE 5 – PRODUCT DESCRIPTIONS AND AVAILABILITY

Products are described and illustrated on the website within each individual product page, which can be consulted before submitting an order. Product availability at the time of ordering should be considered purely indicative, as due to multiple users being present on the website simultaneously, products may be sold to other customers before the order is confirmed. In the event of temporary unavailability of ordered products, the Seller will promptly notify the Customer, who may choose to place a partial order, wait for restocking, or cancel the order. The Seller reserves the right to change product prices published on the website at any time and at its sole discretion, and undertakes to apply the prices in effect at the time the order is recorded.

ARTICLE 6 – PAYMENT METHODS

Payment for purchased products, including related shipping costs, can be made securely using the following methods:

  • PayPal (an eBay Group company, a leading provider of fast and secure online payments.) Upon selecting this option, the Customer will be redirected to the PayPal website, where they can log in using their personal email address and password. When paying via PayPal, the amount will be charged directly to the linked credit or prepaid card. The Seller will never have access to sensitive data and therefore accepts no liability for any malfunctions or potential data breaches. Upon each successful transaction, PayPal will send the Customer a confirmation email. The order amount will be charged to the PayPal account at the time the order is processed. Under no circumstances can the Seller be held liable for any fraudulent or unlawful use of credit cards by third parties when paying for products purchased on its website.

  • Advance bank transfer Once the purchase is completed, the Customer will receive an order summary by email, including the Seller's bank details. When paying by bank transfer, products will be dispatched following confirmation from the bank that the payment has been received. After making the payment, the Customer is advised to send a scanned copy of the payment receipt — indicating the CRO reference number — to the email address info@fabiox.it. The bank transfer description must include the order confirmation number received by email, along with the first and last name of the account holder. Payment by bank transfer must be made within 3 days of the order date. If payment is not received within 7 days, the order will be automatically cancelled.

ARTICLE 7 – SHIPPING AND DELIVERY

The Seller will deliver products throughout the national territory via express courier, at a cost of €6.00 charged to the Customer, to the address specified in the order form; this address cannot be changed once submitted via the online form. Depending on the destination, deliveries may take between 2 and 5 working days. Delivery times are in any case to be considered indicative. Delivery is deemed complete when the products are made available to the Customer at the address specified in the order form. Upon receipt of the goods, the Customer is required to check that the number of packages matches what is indicated on the delivery note, and that the packaging is intact, undamaged, dry, and unaltered. Any visible damage or discrepancy in the number of packages must be immediately reported to the courier at the time of delivery by noting "accepted with reservation" on the accompanying document, and confirmed within 8 days by recorded delivery letter with return receipt to the courier. The Customer is also required to notify the Seller immediately by email at info@fabiox.it. Even when packaging appears intact, the goods must be inspected within eight days of receipt. Any damage or missing items must be reported in writing by recorded delivery letter with return receipt to the courier. In this case as well, immediate notification to the Seller by email at info@fabiox.it is required.

Failed Delivery In the event of failed delivery due to the Customer's absence at the address specified in the order form, the courier will leave a "delivery attempt notice" in the letterbox. The products will be held at the courier's depot for the following 5 calendar days, during which the courier will make a second delivery attempt. If this also fails, the Customer must contact the relevant courier branch to request that the products be held there, and must arrange to collect them in person. After the storage period has elapsed, the products will be returned to the Seller due to non-collection by the Customer. To arrange a second shipment of ordered and paid-for products, the Customer must contact the Seller by email at info@fabiox.it. Once all appropriate checks have been carried out, the Seller may resend the purchased products to the Customer, subject to payment of shipping costs. If the Customer does not send the Seller an explicit request for the products within 15 days of their return to the Seller, the purchase contract shall be deemed automatically terminated and the order cancelled. In such case, the Seller will refund the Customer the amount paid, net of the costs of the failed delivery, the costs of returning the products to the Seller, and any storage costs.

ARTICLE 8 – CUSTOMER SERVICE

For information or clarification, Customers may contact Customer Service by emailing info@fabiox.it.

ARTICLE 9 – RIGHT OF WITHDRAWAL

In accordance with current legal provisions, the Customer (consumer) has the right to withdraw from the purchase, without any penalty and without stating a reason, within 14 days from the date of receipt of the products. For orders placed from 19 June 2026 onwards, the Customer may exercise the right of withdrawal directly online, using the dedicated function available in the "My Orders" section of their account, by clicking the "Request Withdrawal" button next to the relevant order. After indicating the products for which withdrawal is requested and the electronic means by which they wish to receive confirmation, the Customer must confirm submission of the request using the "Submit Request" button: only upon this second action shall the withdrawal notice be considered transmitted. The Seller will send an acknowledgement of receipt on a durable medium (email), stating the content of the declaration and the date and time of transmission, which shall serve as proof of compliance with the applicable deadlines. Alternatively, the Customer may also exercise their right of withdrawal by:

  • recorded delivery letter with return receipt, addressed to: Fabiox – Via Marconi no. 21 – 47034 Forlimpopoli (FC)
  • certified email (PEC) to: fabiox@pec.it

In these two cases, the communication must include the details of the purchased products and the bank or postal account details to which the refund should be credited (if this information is not provided via the online function, it will be requested separately during the refund process). The right of withdrawal is subject to the following conditions:

  • the right applies to the purchased product in its entirety;
  • the purchased item must be intact and returned in its original, sealed packaging, complete with all components (documentation, gifts, accessories, etc.);
  • in accordance with applicable law, return shipping costs are the Customer's responsibility;
  • the product must be returned within 14 days from the date on which the Customer communicated their withdrawal, using a courier of their choice.

Returned products will be inspected by the Seller to assess any damage or tampering unrelated to transit. Once the integrity of the goods has been verified, the Seller will refund the Customer the amount already paid (product price and original delivery costs), using the same payment method used for the initial purchase, within 14 days from the date of withdrawal and receipt of the returned goods. The right of withdrawal does not apply to contracts for the sale of personalised or made-to-measure products.

ARTICLE 10 – LIMITATION OF LIABILITY

The products offered comply with current Italian legislation and the regulations applicable in Italy. The Seller accepts no liability for any errors or omissions in the photos or text appearing on this website, as these are not contractually binding and are published for informational purposes only. The Seller is not liable for any damage caused by its products due to improper use by the Customer. The Seller's maximum and cumulative liability for any claim or obligation — including obligations under indemnification commitments, whether or not covered by insurance — shall in no case exceed the cost of the products subject to the claim. Claims for defective products must be submitted to the Seller in writing within eight (8) days of the date of delivery. For defects not detectable upon receipt, this period shall run, under penalty of forfeiture, from the discovery of the defect. The warranty to the Customer is in any case expressly limited to the free repair or replacement of defective products, at the Seller's discretion, excluding any compensation for further damages or expenses of any nature. Products subject to a claim may not be returned to the Seller or otherwise disposed of, processed, or transferred without the Seller's consent. The Seller shall not be liable for any delay or failure to fulfil the obligations set out in these General Terms where such delay or failure results from unforeseeable circumstances or force majeure beyond its control. No liability may be attributed to the Seller for any damages, losses, lost profits, costs (direct or indirect), or any other harm arising from its products, their use, or the procedures relating to the online transaction, unless such harm results from a direct and serious breach of the sale contract by the Seller.

ARTICLE 11 – PERSONAL DATA PROTECTION

The Seller undertakes not to disclose to third parties any information communicated by the Customer. Such information is confidential. It will be used by the Seller's internal departments solely for the purpose of processing orders and for enhancing and personalising communications and product offerings to Customers, in particular via newsletter. This article shall not prevent the global transfer of the company or the transfer of activities to third parties. Information relating to your order is subject to automated data processing, for which Fabiox is the data controller. The purpose of this automated data processing is to define a transaction analysis level and to combat credit card fraud. Fabiox is the recipient of data relating to your order. Failure to provide order-related data will prevent the completion and analysis of your transaction.

ARTICLE 12 – INTELLECTUAL PROPERTY

All content on www.fabiox.it — including trademarks, models, distinctive signs, logos, works of authorship, written or graphic texts, articles, illustrations, photographs, images, videos, audio files, and any other material in any format, including each individual web page — is the exclusive property of Fabiox di Fabio Bertini and is therefore protected by copyright and intellectual property law throughout the world. The conclusion of any contract under these General Terms does not transfer any related rights to the Customer. Reproduction (even partial), dissemination, modification, copying, distribution, sale, or exploitation of Intellectual Property is strictly prohibited. Any use, even partial, of such content is prohibited without the prior written authorisation of Fabiox di Fabio Bertini and constitutes an infringement of intellectual property rights and/or other related rights (including de facto rights) subject to legal sanctions.

ARTICLE 13 – APPLICABLE LAW AND JURISDICTION

The purchase contract between the Seller and the Customer, as governed by these General Terms, is deemed to have been concluded in Italy and is regulated by Italian law. Any dispute may first be referred to our Customer Service; in the absence of an amicable agreement, the Court of Forlì shall have exclusive jurisdiction. Should the Seller prevail in any legal proceedings, the claimant shall reimburse the Seller for all costs incurred in its defence, including legal fees and court expenses.

ARTICLE 14 – COMMUNICATIONS AND COMPLAINTS

For any communication, clarification, or complaint relating to the purchase contract, the Customer must send an email to info@fabiox.it.

ARTICLE 15 – GOVERNING LAW

Matters not expressly covered by this contract shall be governed by applicable Italian law.
